Fences in West Melbourne, Florida
West Melbourne has seen significant growth from new subdivision development in recent years, and much of that new construction arrives with an HOA already in place.
West Melbourne's own code (Ch. 98, Art. V, Div. 5) caps the portion of a fence between the front building face and the front lot line at 4 ft; behind the front building face, the general maximum is 6 ft. On a corner lot, the portion within 10 ft of the side right-of-way is capped at 4 ft, and the portion set back 10 ft or more from it can go to 6 ft. Fences are prohibited in the sight triangle at rear lines abutting a right-of-way, measured 10 ft from the intersection point. A building permit is required before any fence or wall goes up.
New subdivisions in Florida commonly come with HOA covenants that specify fence style, height and material before a homeowner ever gets to the city permit — worth checking your HOA's governing documents first if the property is in a newer West Melbourne development, since that approval sits on top of, not instead of, the city permit.
Two approvals, not one, on a newer lot
On a recently built West Melbourne property, the HOA's design requirements and the city's permit are two separate gates — clearing one does not clear the other. Sort out what the HOA allows before ordering material, since re-doing a fence to satisfy an HOA after the fact costs more than asking first.
