Fences in Melbourne, Florida

Melbourne issues its own fence permits — one of Brevard's older incorporated cities, with a code separate from the county's.

Melbourne's own code (Land Development Regs., Ch. 9, Art. III, Sec. 9.43) caps a fence in a required front yard at 4 ft, with a general 6 ft maximum elsewhere. Corner lots can go to 6 ft too, except the zone between the front building line and the street, which stays capped at 4 ft. A front-yard fence also can't be more than 50% opaque. No fence, sign or structure may obstruct vision clearance at corners, curb cuts or railroad crossings, and a building permit is required for any fence or wall in the city.

Melbourne has a lot of pools, and that makes the state's pool-barrier law relevant to a fence conversation here more often than in most cities on this list.

A privacy fence is not automatically pool-code

Florida's Residential Swimming Pool Safety Act (Fla. Stat. §515.29) requires a pool barrier with no gap a young child could crawl under, squeeze through, or climb over; the Florida Building Code gives that standard a specific measurement — no opening may allow the passage of a 4-inch-diameter sphere (FBC Residential §R4501.17 / FBC Building §454.2.17.1.2). The barrier also generally has to be separate from the yard fence, unless that fence sits on the pool's own perimeter and independently meets every requirement, gate included. A standard 6 ft privacy fence around the back yard does not satisfy the pool-barrier law just because it's taller and encloses the yard.
