Fences in Merritt Island, Florida

Merritt Island is unincorporated — there is no city government, so Brevard County itself issues the fence permit.

Merritt Island sits between the Indian River on the west and the Banana River on the east, with canal-front lots common on both sides. Salt-laden air arriving from two directions is one of the bigger factors in what material holds up on a given lot here.

Because it's unincorporated, county rules apply directly (Brevard County Code Ch. 22, Art. VIII and §62-2109): residential fences and solid walls max out at 6 ft, drop to a 4 ft maximum in the front setback and on a corner lot's side-street setback, and drop further to 3.5 ft inside the sight triangle at a street intersection.

The county, not a city, issues the permit here

Brevard County's Building Permits division handles it, not a Merritt Island city hall — there isn't one. A permit is required to build a new fence or make a major repair; replacing under half of an existing fence with the same size and material in the same spot does not require one.
